What are the Legal Definitions of Improper, Unfair, and Unethical Questions?


"In appearing in his professional capacity before a tribunal, a lawyer shall not . . .

Ask a Witness a Question solely for the purpose of harassing him . . . or

Ask any question that he has no reasonable basis to believe is relevant to the case and that is intended to degrade a witness or other person.*

Cross-examination must be carried out according to the rules of ethics established by the Model Code of Professional Responsibility of the American Bar Association, always avoiding "harrassment or undue embarrassment" of the witness, pursuant to FRE 611 (a)(3) which states: "The court shall exercise reasonable control over the mode and order of interrogating witnesses and presenting evidence so as to (3) protect witnesses from harassment or undue embarrassment."
